Terms of Service

1. Acceptance & Definitions
By using Pushbase services (the “Platform”), you (“Developer”) agree to these Terms. Definitions:
  • Pushbase – the company providing the Platform.
  • Developer – you, the user of the Platform offering applications to Final Users. Using the Platform constitutes acceptance of these Terms.
2. Account Responsibility
  • Intended for professional Developers only.
  • You must provide accurate account information and safeguard your credentials.
  • Notify Pushbase immediately if you suspect unauthorized access.
  • You are responsible for complying with applicable laws—including export regulations.
3. Platform Usage
  • Access only via intended interfaces and APIs.
  • Use the Platform solely to support your Applications; no reverse-engineering, competitive product creation, or IP claims are allowed.
4. Data Retention & Security
  • You must comply with Pushbase’s Acceptable Use Policy and Privacy Policy.
  • You bear responsibility for informing Final Users about privacy practices and ensuring consent for data use.
  • If Final Users provide personal data, they need to be informed it may be shared with both you and Pushbase.
5. Subscription Terms & Billing
  • Access to the Platform is via a monthly subscription, auto-renewing until canceled.
  • Plans, pricing, and overage fees are detailed on the Website. Starting a month means the full month’s fee is due.
  • You can upgrade or downgrade anytime; billing adjustments apply pro rata.
  • Cancellation must be initiated before the next billing cycle. Pushbase may terminate with one month’s notice, upon which your account and data will be deleted.
  • Payments are processed via a third-party (e.g., Stripe or PayPal); Pushbase does not store payment data.
  • Fee changes will be communicated at least 15 days before take effect.
6. Content Ownership & Rights
  • You retain ownership of your Applications and Content.
  • Pushbase grants you a non-exclusive, royalty-free license to use the Platform. Developers control data retention for their End Users.
  • You grant Pushbase a license to host, reproduce, and display your Content to deliver Platform services.
  • If you submit feedback or ideas, Pushbase may freely use them as it sees fit.
7. Platform Changes & Termination
  • Pushbase may modify Platform features, pricing, or functionality at any time.
  • You may cancel at any time via your account. No refunds for partial months.
  • You grant Pushbase a license to host, reproduce, and display your Content to deliver Platform services.
  • Pushbase can suspend or terminate access—including data access—immediately, but will provide reasonable export options when possible.
8. Warranties & Limitations
  • The Platform is provided “as is” without warranties of any kind.
  • Liability is limited to direct damages only; Pushbase is not liable for indirect, incidental, or consequential losses (e.g., lost profits, reputation, data).
9. Indemnification
You agree to indemnify Pushbase and its affiliates from any claims, damages, liabilities, or expenses arising from your use of the Platform, your Content, or violation of these Terms or applicable laws.
10. Changes to These Terms
Substantive changes will be communicated at least one month before taking effect. Continued use implies acceptance.
11. Governing Law & Jurisdiction
These Terms are governed by the laws of your jurisdiction (or specify locality). Any disputes shall be resolved in your local courts, subject to mandatory legal provisions if different.
